– PROTECTION FROM ABUSE –
Protection from Abuse:
Domestic violence is a pattern of abusive behavior within a family or between partners that can be in the form of physical or sexual abuse, rape, incest, stalking, and harassment, such as direct threats instilling fear of being harmed. In Pennsylvania, if you are a victim of domestic violence, you can seek a protection from abuse (PFA) order that will prohibit the alleged abuser from having any contact with you or your children, if they are subject to the abuse. Given the serious implications surrounding PFA orders, Molavoque Law can advise you of your legal rights and the process, whether you are seeking protection from abuse or you are accused of actions giving rise to a PFA order against you. Often times, a PFA action impacts the divorce , custody, child support, and spousal support processes as well. At Molavoque Law, we are committed to compassionately and assertively advocating for your legal rights and protection to ensure safety and security within your own home.
While our firm believes in zero tolerance for domestic violence, we must ensure there is a valid legal basis for relief under the Protection from Abuse Act. Because of the impact a PFA can have on other domestic legal situations, often times PFA actions are brought to circumvent other legal processes, such as child custody, and to obtain relief when there are no legal grounds to do so. In these situations, Molavoque Law provides a strong defense to those who have been accused of domestic violence in an attempt to gain leverage in a custody battle or divorce, or otherwise.
Whether you are a victim of domestic abuse or a defendant wrongly accused, contact Kristin A. Molavoque, Esquire for compassionate legal advice and unwavering representation to protect your rights.
Protection from Intimidation or Protection from Sexual Violence:
Unfortunately, often times individuals are victims of sexual abuse or intimidation that occurs outside the confines of a household or family relationship. Much like the relief granted in protection from abuse matters, relief also is available in intimidation and sexual violence cases to victims under the age of eighteen who have suffered either intimidation, in the form of stalking or harassment by someone over age eighteen, or who have suffered sexual violence at the hands of an adult or minor perpetrator. However, un-emancipated minor victims must have an adult household member, parent, or guardian file the petition on their behalves.
Given the emotional nature, seriousness, and sensitivity surrounding intimidation and sexual violence issues, Molavoque Law provides a trusted environment to discuss your individual case and help you understand your legal rights.
