PRACTICE AREAS > FAMILY LAW > EQUITABLE DISTRIBUTION OF ASSETS AND LIABILITIES

– EQUITABLE DISTRIBUTION OF ASSETS
AND LIABILITIES –

Contrary to what you might think, “equitable” does not necessarily mean equal or fifty-fifty when it comes to distributing assets and debts in a Pennsylvania divorce proceeding. As an equitable distribution state, Pennsylvania courts divide marital property and debts based on the principles of equity or fairness, considering a number of factors, similar to the factors used to determine alimony. One of the first steps in the equitable distribution process is designating and separating marital assets and liabilities from individual ones, such as non-marital, pre-marital, or post-separation assets/liabilities, and valuing those deemed marital. Molavoque Law has the expertise and resources to assist you in making those determinations and leveraging equitable property division. Understanding that financial security can be worrisome and that every case is unique, our firm will actively listen to your needs, advise, and assertively advocate on your behalf to achieve your goals and protect your property rights, either in or out of court.

While distribution of marital assets often can be a contentious process, if the divorcing couple can collaboratively decide upon what is fair and equitable, Molavoque Law can help you arrive at a mutually agreed-upon property division in the form of a marital/property settlement agreement, as part of your divorce mediation or divorce representation. As an experienced mediator, sensitive to the emotional nature of a divorce proceeding, Kristin A. Molavoque will provide a neutral and safe environment, empowering you as a couple to control the resolution of your divorce and division of your property. Of course, each party has the right to obtain separate legal counsel throughout the mediation process.
