– PRE AND POST NUPTIAL AGREEMENTS –

Prenuptial Agreements:

When you are about to be married, the last thing you are thinking about is what happens if you get a divorce. However, from a financial perspective, if either or both future spouses have considerable assets or assets that they wish to keep separate from the other spouse, potential inheritances, business interests, or even substantial liabilities, it is wise to consider a prenuptial agreement. Think of a prenuptial agreement as similar to an insurance policy, where you insure yourself in the event of fire or natural disaster with property insurance, or premature death with life insurance. A prenuptial agreement can bring peace of mind and provides a legally binding plan to protect you, your assets, and your family, in the event of a divorce.

Understanding the sensitive nature of prenuptial agreements, Molavoque Law provides a compassionate environment to creatively tailor a plan that helps you establish and maintain financial integrity in your marriage and limit potential issues in the event of divorce. Upon entering the prenuptial agreement, each party must understand, be comfortable with, and willingly accept the terms of the agreement. Molavoque Law is committed to helping you negotiate and execute the terms of the agreement as efficiently as possible, ensuring that you understand your legal rights while carrying out your wishes.

Postnuptial Agreements:

As the name implies, a postnuptial agreement is entered into while a couple is married as opposed to beforehand. It is an enforceable contract between spouses that can protect individual financial assets and improve domestic affairs, especially in the event of a future divorce. Similar to prenuptial agreements, the terms usually are focused on protection of assets or income. As with prenuptial agreements, Molavoque Law provides sophisticated, compassionate, and comprehensive counsel to ensure full and fair disclosure of assets and liabilities at the time of the agreement, which underpins the enforceability of the postnuptial agreement as well as the prenuptial agreement.

Whether you are recently engaged and considering entering into a prenuptial agreement, or married and would like a postnuptial agreement, contact Kristin A. Molavoque, Esquire to discuss your situation and create a plan to ensure your future protection.
